Diziana Licensing | Zendesk Theme License Terms & Usage Policy

By downloading the themes, you hereby accept and agree to abide by the terms and conditions contained in this Free and Premium Theme Usage License Agreement ("License"). If you are acting on behalf of a company or an organization, you represent and warrant that you are authorized to act as such and have requisite permissions and authorizations to bind such company and/or organization to this License.

FREE THEME LICENSE

The Free Theme License grants you a non-exclusive, non-transferable right to make use of the Product, subject to the following terms, conditions and restrictions:

What you can do with it

• You can only use it on Public instances of Zendesk Help Center (i.e. Free Themes can't be used on Private Zendesk Help Centers).
• You are allowed to download and modify the theme for any number of projects and for any number of clients by attributing the theme to its author (i.e. Diziana / Diziana Zendesk® Theme).
• You can make a unique website design that's based on a free theme for a client.
• In order to use this theme or a part of it, you must attribute it to its author (Diziana), so Diziana will be able to continue creating awesome free theme resources for you.

How to attribute it?

Please copy this code on your website to accredit the author using the following HTML code. You must put the following in a very clear and visible manner in the footer of all pages of your Zendesk Help Center. We think the footer of help-desk pages is the best place to put any kind of attribution/credits.

What you can't do with it

• You can't use it on Private Zendesk Help Center(s).
• You cannot redistribute, resell, or license a unique website design that's based on a free theme (created for a client) on a third party marketplace or another client.
• You can't redistribute, resell, lease, license, sub-license or offer a free theme as-is or customized-version or any individual component of the free theme to any third party or marketplace.

Miscellaneous info

• Diziana retains ownership of the theme but grants you the license on the terms above. This license is between Diziana and you.
• If a breach in this license is discovered, Diziana may take legal action.

SINGLE-SITE LICENSE

The Single-Site License grants you a non-exclusive, one-time-transferable-per-license right to make use of the theme, subject to the following terms, conditions and restrictions:

• The Single Use License gives you, the purchaser, the ability to use the theme on an ongoing, non-exclusive basis.
• You are allowed to use the theme to create one single End Product for yourself or for one client (a "single application"), and the End Product can be distributed for free.
• The "End Product" is the final customized version/implementation of the theme that you will use or sell to a client.

In other words... You can use a Paid Theme for only one person/business/project. If you want to use the purchased theme for a different client or project then you will have to purchase another license (by purchasing the theme again). The theme can be customized to any degree (adding, altering or removing text, images, graphics, layout, design, etc) to fit your project's needs.

What you can do with it

• You can create one End Product for a client, and after you're done, you can transfer it over to the client for any fee. This license is then transferred to the client.
• You can modify this theme and manipulate it. The resulting works are subject to this license. This means no matter how much you modified a site that was based on this theme, the resulting work is still subject to this license.
• You can download the theme and use it without attributing back to Diziana.

In other words... You can do anything to a theme and use it for one project or sell it to one person/business. You can also purchase a new license if you want to use a newly-purchased or customized theme for another person/business/project.

• If a breach in this license is discovered, Diziana may revoke the license and take legal actions.
• We use some images (licensed under creative-commons) for demo purposes or as placeholders. The copyright of all those images belongs to their respective owners. A list of such images along with link to original image, and name of their authors is available at https://www.diziana.com/image-credits.
• We provide or link to third party libraries, their respective licenses are included wherever libraries/code is used.

THE SOFTWARE (THEMES, PLUGINS, TOOLS, ETC.) IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
